PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE LOS TR3S
REYES APP.
These Terms of Service (“Terms”) govern your access to and use of the Los Tr3s Reyes mobile
application (the “App”) and any related services provided by Los Tres Reyes LLC (“Los Tres
Reyes LLC,” “Company,” “we,” “our,” or “us”).
By accessing or using the App, you agree to be bound by these Terms and our Privacy Policy. If
you do not agree to these Terms, you must not use the App.
1. ELIGIBILITY AND AGE REQUIREMENT
1.1 Age Requirement
The App is intended strictly for users who are at least eighteen (18) years of age or the age of
majority in their jurisdiction, whichever is higher. By using the App, you represent and warrant
that:
- You are at least 18 years old; and
- You are legally permitted to use the App under the laws of your jurisdiction.
1.2 Jurisdictional Restrictions
You may not use the App if doing so is prohibited by the laws of your country, state, or region. It
is your responsibility to ensure that your use of the App complies with all applicable laws and
regulations.
1.3 No Use by Children
We do not knowingly permit or collect information from individuals under the age of 18. If we
become aware that a minor has created an account, we will terminate the account and delete
associated data consistent with our Privacy Policy.
2. NATURE OF THE SERVICE – SOCIAL GAMING ONLY
2.1 Entertainment Purpose Only
Los Tr3s Reyes is a social gaming entertainment app. It is not a real-money gambling platform.
The App allows users to play casino-style games for fun using virtual items within the App.
2.2 No Real Money Gambling
The App does not allow:
- Wagers of real-world money on the outcome of games; or
- Withdrawal, redemption, or conversion of virtual items into real-world money, prizes, or
anything of monetary value outside the App.
Practice or success at social gaming within the App does not imply or guarantee future success
at any form of gambling.
3. VIRTUAL COINS AND CHIPS
3.1 License to Use Virtual Items
Within the App, you may obtain access to virtual in-app items, including but not limited to “Virtual
Coins” and “Chips” (collectively, “Virtual Items”). Virtual Coins may be converted into Chips for
gameplay purposes only.
When you obtain Virtual Items, you receive a limited, personal, revocable, non-transferable, and
non-sublicensable license to use such items solely within the App for entertainment purposes.
3.2 No Cash Value
Virtual Coins and Chips:
- Have no real-world monetary value.
- Are not real currency.
- Cannot be exchanged for cash or any form of real-world credit.
- Cannot be redeemed for goods or services outside the App.
- Cannot be transferred, sold, gifted, or traded to other users, except through features expressly
permitted within the App.
3.3 All Sales Are Final
Unless required by applicable law or explicitly stated otherwise, all purchases of Virtual Items
are final and non-refundable. This includes situations where:
- Your account is terminated or suspended.
- You stop using the App.
- You lose access to Virtual Items due to device issues, uninstalls, or technical errors.
3.4 Changes to Virtual Items
We reserve the right, in our sole discretion, to:
- Add, remove, or modify Virtual Items.
- Adjust pricing.
- Change the ways Virtual Items are earned, purchased, or used.
- Limit or discontinue certain features at any time.
4. ACCOUNT REGISTRATION AND SECURITY
4.1 Account Creation
To access certain features, you may need to create an account. You agree to provide accurate,
current, and complete information, including:
- Email address
- Username
- Phone number
- Password
4.2 Account Security
You are responsible for maintaining the confidentiality of your login credentials and for all activity
that occurs under your account. You agree to:
- Notify us immediately of any unauthorized use or suspected breach.
- Use a strong and unique password.
- Not share your account or login details with any other person.
4.3 One Account Per User
We may limit or restrict users from creating multiple accounts if we determine it impacts fairness
or security.
5. USER CONDUCT AND CODE OF CONDUCT
5.1 General Conduct
You agree that you will not:
- Use the App for any unlawful, fraudulent, or harmful purpose.
- Harass, threaten, abuse, or harm other users or Company staff.
- Attempt to interfere with or disrupt the App, servers, or networks.
- Use bots, scripts, automation tools, or unauthorized third-party software.
- Exploit bugs, cheats, or vulnerabilities to gain an unfair advantage.
- Attempt to access another user’s account or personal information.
5.2 Prohibited Content
You may not use the App to upload, display, or otherwise share any content (including profile
photos) that is:
- Illegal, defamatory, or invasive of privacy.
- Hateful, discriminatory, or harassing.
- Sexually explicit, pornographic, or violent.
- Promoting gambling, drugs, or criminal activity.
- Violating intellectual property rights of others.
We reserve the right to remove content and suspend or terminate accounts that violate these
rules.
6. USER-GENERATED CONTENT (PROFILE PHOTOS)
6.1 Limited UGC
The App currently allows users to upload a profile picture or avatar. This is considered
“User-Generated Content” (“UGC”).
6.2 License to Use UGC
By uploading UGC, you grant Los Tres Reyes LLC a non-exclusive, worldwide, royalty-free,
sublicensable license to:
- Use, display, and reproduce your UGC within the App.
- Use your UGC to operate, improve, and promote the App, in accordance with applicable laws.
You retain ownership of your UGC, subject to this license.
6.3 Responsibility for UGC
You are solely responsible for:
- The content of your profile picture.
- Ensuring you have the necessary rights to use and upload the image.
- Ensuring your UGC does not violate these Terms or any laws.
We may remove or disable any UGC at our discretion.
7. INTELLECTUAL PROPERTY
7.1 Our Content
All content in the App, including but not limited to:
- Game designs
- Graphics, animations, and artwork
- Logos and trademarks
- Audio and music
- Text and interfaces
- Software and code
is owned by or licensed to Los Tres Reyes LLC and is protected by intellectual property laws.
7.2 Restrictions
You may not:
- Copy, reproduce, modify, or create derivative works based on the App.
- Reverse engineer, decompile, or disassemble the App.
- Remove or alter any copyright, trademark, or proprietary notices.
- Use our trademarks (“Los Tres Reyes LLC,” “Los Tr3s Reyes,” or any logos) without our prior
written consent.
8. PAYMENTS AND THIRD-PARTY SERVICES
8.1 Payment Processing
Real-money payments for Virtual Coins are processed by third-party payment providers,
including:
- Authorize.Net / Paysafe
- PayPal
- Google Pay
- Apple Pay
By making a purchase, you agree to the terms, conditions, and privacy policies of the relevant
payment provider.
8.2 No Storage of Full Card Data
Los Tres Reyes LLC does not collect or store full credit or debit card numbers, CVV codes, or
bank account details. Payment information is handled directly by the payment provider.
8.3 Platform Fees and Taxes
You are responsible for:
- Any fees charged by the app store (Apple App Store / Google Play).
- Any taxes or duties applicable to your purchases, where required by law.
8.4 Chargebacks and Fraud
If we suspect fraudulent activity, payment disputes, or chargebacks, we may:
- Suspend or terminate your account.
- Remove or revoke Virtual Items.
- Report the incident to payment processors or lawful authorities.
9. DMCA AND COPYRIGHT POLICY
9.1 Respect for IP
We respect the intellectual property rights of others and expect users to do the same.
9.2 DMCA Notices
If you believe that any content in the App infringes your copyright, you may send a notice
including:
- Your name and contact information.
- Identification of the copyrighted work.
- Identification of the allegedly infringing material.
- A statement that you have a good faith belief that use of the material is not authorized.
- A statement, under penalty of perjury, that the information is accurate and that you are
authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.

We may remove or disable access to the allegedly infringing material in accordance with
applicable law.
10. TERMINATION AND SUSPENSION
10.1 Our Right to Terminate
We may suspend or terminate your account at any time, with or without notice, if:
- You violate these Terms or our Privacy Policy.
- We suspect fraud, abuse, or illegal activity.
- We are required to do so by law or by a platform provider.
10.2 Effect of Termination
Upon termination:
- Your license to use the App and Virtual Items will end.
- You may lose access to your account, progress, and Virtual Items.
- Unless required by applicable law, no refunds will be provided.
10.3 Your Right to Stop Using the App
You may stop using the App at any time and may request account deletion as described in our
Privacy Policy.
11. DISCLAIMER OF WARRANTIES
THE APP, INCLUDING ALL CONTENT, FEATURES, AND VIRTUAL ITEMS, IS PROVIDED “AS
IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS
OR IMPLIED.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOS TRES REYES LLC DISCLAIMS ALL
WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY,
- FITNESS FOR A PARTICULAR PURPOSE,
- NON-INFRINGEMENT,
- AVAILABILITY, RELIABILITY, OR ACCURACY OF THE APP.
WE DO NOT WARRANT THAT:
- THE APP WILL BE UNINTERRUPTED OR ERROR-FREE,
- DEFECTS WILL BE CORRECTED,
- THE APP OR SERVERS ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
12. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOS TRES REYES LLC, ITS OFFICERS,
DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES,
- LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL,
- DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP,
- DAMAGES RELATED TO VIRTUAL ITEMS, INCLUDING LOSS OR DELETION.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF:
- THE AMOUNT YOU HAVE PAID TO US IN THE PAST SIX (6) MONTHS, OR
- ONE HUNDRED U.S. DOLLARS (USD $100).
SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY, SO SOME OF THE
ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
13. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Los Tres Reyes LLC and its officers,
directors, employees, agents, and affiliates from and against any claims, liabilities, damages,
losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- Your use of the App,
- Your violation of these Terms,
- Your violation of any rights of another person or entity,
- Your UGC or conduct within the App.
14. CHANGES TO THE APP AND TO THESE TERMS
We may, at our discretion:
- Modify, update, or discontinue the App or any part of it.
- Change these Terms from time to time.
When we make material changes, we will update the “Last Updated” date above and may
provide additional notice within the App. Your continued use of the App after changes become
effective constitutes your acceptance of the updated Terms.
If you do not agree with any changes, you must stop using the App.
15. GOVERNING LAW AND JURISDICTION
These Terms are governed by and construed in accordance with the laws of the State of
California, United States, without giving effect to conflict-of-law principles.
Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive
jurisdiction of the state and federal courts located in San Diego County, California, and you
consent to the personal jurisdiction of such courts.
16. SEVERABILITY
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall
be enforced to the maximum extent permissible and the remaining provisions shall remain in full
force and effect.
17. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior
written consent. We may assign or transfer these Terms, in whole or in part, without restriction,
including in connection with a merger, acquisition, or sale of assets.
18. ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any additional policies or guidelines
referenced herein, constitute the entire agreement between you and Los Tres Reyes LLC
regarding your use of the App and supersede all prior agreements or understandings, whether
written or oral.
